Police: Kokomo man fired round into convenience store

A Kokomo man faces a felony charge of criminal recklessness after police said he fired a handgun in December into a convenience store, shattering a door but leaving the occupants uninjured.

Howard County Sheriff’s Department deputies arrested Jonathan L. Capers, 27, on a warrant for criminal recklessness, a level 5 felony, carrying a handgun without a license, a level 5 felony, and unlawful possession of a handgun by a domestic batterer, a misdemeanor.

According to a probable cause affidavit, on Dec. 17, 2017, a clerk at a convenience store on East Markland Avenue reported several individuals entered the store in the early morning hours. There was then some sort of a commotion outside followed by a single gunshot.

The round shattered a glass door, and police found a spent 9mm shell casing just outside the business.

Surveillance footage would just a few days later shed more light on the incident.

Court documents state that a male wearing a jacket with the name “Gino Gambino” printed on the back entered the store – police later claimed that the man was Capers. He left the store and confronted another male outside, and a brief physical altercation ensued, according to court documents.

Capers is then seen approaching the vehicle he arrived in as a passenger. “The suspect is handed a gun from a male in the car,” state court documents. He then allegedly chased the male he fought into the store, firing one round after him, missing the other male and everyone else in the store, but hitting the glass door.

The suspect is then depicted on camera, police say, pointing the handgun into the store for a short time, before everyone flees the scene prior to police’s arrival.

Police claim that, based on the video footage, they were able to identify Capers as the man firing the handgun.

In January, a warrant was filed for his arrest. Court documents indicate the Howard County Prosecutor’s Office pushed for an increased bond, citing past convictions.

Capers was taken into custody Friday afternoon at the Howard County Sheriff’s Department. He’s being held without bond, due to additional active warrants for failure to appear in court, petition to revoke a suspended sentence and body attachment. On the criminal recklessness warrant, he has a bond of $25,000, with no 10 percent cash alternative allowed.

Trial set in June 29 shooting

With his not guilty plea entered, Kareen Dunn is headed to a jury trial on an attempted murder charge.

Dunn faces the Class A felony charge in connection with a June 29 shooting in the 600 block of East Mulberry Street that injured an Indianapolis man.

Dunn appeared in Howard Superior Court 4 Thursday via teleconferencing from the Howard County jail. He told the court he intended to hire an attorney to represent him. Dunn is set to reappear in court Oct. 12 for a pretrial hearing and Nov. 7 for a jury trial.

Police accuse Dunn of shooting 24-year-old Richard Pippens in the back. Pippens survived the shooting.

Prosecutors also charged Dunn with a petition to revoke charge that accuses him of violating his probation on a prior criminal recklessness conviction.

Dunn was arrested Aug. 10 in Illinois following a traffic stop and returned to the Howard County jail. He is being held on $75,000 bail with 10 percent bond on the attempted murder charge, and a $10,000 cash-only bail on the petition to revoke.

Dunn could serve up to 50 years in prison if he’s convicted on the Class A felony charge of attempted murder.

Police also charged Jonathan Capers, 22, with false informing in the case. Police say he lied to investigators about his involvement in the shooting.

Capers was with Dunn during the shooting, according to a probable cause affidavit. Capers is set to stand trial Oct. 12, unless he pleads guilty or agrees to a plea bargain. Capers could get up to a year in jail if convicted of the Class A misdemeanor.
